Post by grmaxx » Wed Jun 19, 2013 10:19 am

I am on a Tier-2 (General Visa) and been in London from December 2011. I would like to understand the following requirements on the ILR as i will be eligible for ILR in December 2016.

Is 180 days per calendar year is allowed to be outside UK

[or]

Is it total 180 days over the period of 5 calendar.

Is there any change in rules and i am unable to get the right details on the requirement.

It is currently 180 days per 12 month period.

Please bear in mind that the rules change frequently so you should check nearer the time what rules are in place as 2016 is still 3 years away and a lot can change in that time.

There is one change coming in April 2016 for certain:
Requirements from 6 April 2016

If you are applying for indefinite leave to remain, you must meet all of the requirements under Immigration Rule 245HF which can be found on the right of this page. You must also show that you are being paid:

£35,000 per year (before tax); or
the correct rate of pay for your job as stated in the codes of practice for Tier 2 sponsors.

Whichever is the higher amount will apply.

Also read the following document
SETTLEMENT - TIER 2 (GENERAL), TIER 2 (SPORTSPERSONS) AND TIER 2 (MINISTERS OF RELIGION), APPLICATIONS MADE ON OR AFTER 6 APRIL 2016

I assume this applies for Tier-2 (General) visa too.
