FLR O REFUSED

Post by mirage » Fri Jun 21, 2013 1:32 am

I am in UK since 4.5 years studied masters and then got PSW meanwhile got married and got a kid 12months old. haven't travelled back to home country since my wife came here to join me about 3 years ago, applied for discretionary leave to remain on the grounds of FLR O, got refused with right to appeal.
NEED SOME SUGGESTIONS ABOUT THE APPEAL AND ITS RESULT, ANY OTHER OPTION IF ANY LEFT.
PLEASE HELP

What was the wording of the refusal and the basis of your application.

HI,
FLR O appeals got refused. refused from upper tribunal as well. now some one has advised me to do the fresh claim,
I am in my 28 days grace period.
please advice me on this fresh claim
1. is it ok to the fresh claim on Flr o application?
2. would my stay will be legal after 28 days if I do the fresh claim ?
01512134288 I tried on this No. but they said they only accept further submission on fail asylum cases. if any one can provide me right contact details ?
where should I contact for the fresh claim on human right grounds.
Is the fresh claim is different from further submission?
please help me.
I need to take some really fast decision because my wife is 5 month pregnant & its to stress full for both of us.

thanks & regards

we don't understand what u want or why you apply for discretionary leave to remain if you are in the uk student
if you want stay and live in the uk you should have family (wife, children they are settled in the uk ILR or british citizen) or you lived in the uk 10 years legally
if you cannot go back to your country because of danger you need to claim asylum

where should I contact for the fresh claim on human right grounds.
What are the human rights grounds that you are applying under??

You have stated your wife joined you, so she is not British or settled and you have a baby, which would take on your nationality and is not automatically British if born in the UK.

For anyone to give you advice, you need to state the refusal wording from the letter and also explain how you think you qualify to apply for FLR(O) under human rights.

It was an Flro application. Coz we married against our parents wish there is threat to our life as case of honor killing. But as the application is refused so are the appeals. The upper tribunal states :Permission to appeal to the upper tribunal has not been accepted / refused with no further right to appeal as excluded decision.
Coz there wasn't any evidence provided. Now we have some evidences which can support that there are cases of honor killing in our area. But the most important thing witch concerns me more is my wife pregnancy. She is in 5th month and don't want to travel.
In this situation some one has advised me to the fresh claim by having an appointment with Ukba in Liverpool.
The UKBA answers that it's only for failed asylum seekers.
I only want to know that is there any thing like that or other way to get extra time until the baby is due.
