Hi Senny (& mum),Senny wrote:mum has been on a student visa for a while. She entered the UK as a visitor in october 2003 and she applied for a student visa before her visitors visa expired in Jan 2004. this took a while and was later granted In April 2004 The college she was at at the time did the application for her all she did was pay.
Over the years since 2004 we have been extending and no gaps in between.
The last extension we did was in October 2010 we where refused visa. My mum changed her place of uni and we made an application which was refused. Our visas were still valid till November 2011. We applied again and we where granted till October 2013.
From my research student visa counts as part of the ten year residency and October this year makes it ten years. Question is am i right about the visitors visa counting towards the 10 years? secondly We would also like to know what documents to present to the UKBA?
Another question is that she has two dependants. One under 18 and one over 18 .
What applications will we have to make?
Which (FLR) form?
and what are the conditions of the FLR visa? How is it granted?
Both dependants have been in the UK permanently since December 2006, but due to the change in immigration rules we can't apply together with the main applicant.
Also my mum would like to go in person rather than postal service . Is this recommended? Reason being postal takes long.
Thank you
Hrmm, Senny, you have shut the door to the same day application in that case. Unless your father can be the applicant using Set O and your mum and you the dependents.Senny wrote:Senny wrote:vinny wrote:Is your mother's adult dependant you, your sibling or your father?
Hi Vinny
I am the adult dependant.

Hi Vinny
I am the adult dependant.
Still, I am curious, and hoping to hear back from Vinny re: the possibility to apply for ILR with one's parent as a dependent.

Spring..
Why does it have to my father the main applicant for us to apply in person.as it stands mum (parent) is the applicant (clocking 10 years in October ) and me and sibling are the dependants (seventh year in UK this year). Me being the older dependant.
Father is not in the equation with the application.. Jus three . Hope this makes sense. .

Hi Vinny, vinny wrote:Do read the given links above.
What is your father's status?
If your father doesn't qualify for ILR under Long residence, then he may apply for FLR(M) with your under 18 year old sibling. I think that you may apply for FLR(O).
Senny wrote:Hi there
My mum who will be here 10 years in October is looking to a apply for 10 years long residency . She has two de dependants one under the age of 18 and the other 24 years. Both dependants have been in the UK for 6 years and 10 months . They are not eligible to apply with her ( according to the lawyer)
My question is which form should my mum use to apply for 10 year long residency?
Which forms should the dependants use , one over the age of 18 and the other under the age of 18.
Can the dependant under the age of 18 apply together with my mother ?
Many thanks
