Tier 1(General) Extension or ILR?

Friends,

My initial visa valid from 05/01/2009 for 3 years then I got 1st extension valid for another 2 years i.e. till 05/01/2014

My first entry into the UK was on 05/04/2009 i.e exactly after 3 months. If I consider 3-month entry concession then it will be 90 days exclude the entry day (05th April 2009). 91 days if I include the entry day.

Please someone suggest, Am I eligible for ILR or required 2nd extension?

From Monday, January 5, 2009

Added 90 days

Result: Sunday, April 5, 2009

Based on that, you would be eligible to apply from 28 days before 05/01/2014 based on satisfying the other requirements.

Just I was confused because the following result in the same website. It says 91 days, end date included.


From and including: Monday, January 5, 2009
To and including: Sunday, April 5, 2009

Result: 91 days
It is 91 days from the start date to the end date, end date included

Or 3 months, 1 day including the end date

I have used http://www.timeanddate.com/date/durationresult.html.

Given start date and end date with option Include end date in calculation.

We need a confirmation that.. Is the arrival day is included or excluded from 90 days.

I have posted query to Settlement Ops Policy Mailbox <SettlementOpsPolicy@homeoffice.gsi.gov.uk>, got the following reply.

Dear Sir,

The guidance actually states that provided the applicant had not delayed their entry to the UK by more than 90 days, they can count this time towards the five year continuous period. Tier 1 (General) applications can be made at a PEO.

I trust this answers your question.

"Absences are counted in "whole days". Day(s) of departure and arrival are not to be included..."
