Date of Applying British Citizenship

Post by 2014 » Mon Sep 30, 2013 3:55 pm

Hi All,

I have achieved ILR on 2nd May 2013. I have got ILR approval letter on the same day. However I received BRP card on 24th May 2103.
Can I apply British citizenship exactly after one year after approval i.e. on 2nd May 2014? As per British citizenship nationality rule 1 year wait is required after 1 year. However 1 year is counted from date of approval letter or date of BRP letter?

This clarification required.

Thanks in advance.

The date of your BRP, so you can apply on or after 24th May 2014 provided you were physically present on this date 5 years earlier.

It is bit strange rule.i got a approval letter on 2 may 2013 which states that I am free from immigration control. I can take up any job etc.
it is good proof to demonstrate that ILR has been obtained on 2 May 2013. UKBA has delayed the delivery of BRP. Why I should wait for additional days. Many people receive BRP cards after months.

Are you sure approval letter will not work as proof for ILR?

Date of Approval is what counts

BRP cards in many cases arrived after the date of approval. In some instances with wrong details and were re-issued. Legally the day you become free of Immigration control is the day you begin the Indefinite Leave period.
cheers

Adding some more info: This BRP card was not issued till 2010 as far as I remember. It was not required for EU nationals. It was issued with an end date and had to be renewed (I presume some money making idea behind it). The main purpose of this was to keep a track of and indentify migrants residing in this country. Legally the date of ILR begins on the date of approval.

Thanks VR.

It means I can apply for british citizen ship on 2nd may 2014. I need not to wait till 24th may 2014.
Note :I have ILR approval letter dated 2 may 2013 and the BRP approval date is 24th may 2013.

If someone do not agree, please write your logic.

All,

Just now i get to know from one of my friend that his BRP card came after 2 months of ILR approval. It is impractical to wait bassed on BRP card when ILR approval letter is handy to help.
