I need a help, about my son's citizenship

Post by pedroluso » Thu Jan 16, 2014 7:42 pm

Hi there people. I am really confused about something, and I am desperate for an answer.
I used to live in London more then 1 year ago, I lived there for 2 years, I have dual citizenship, Brazilian and Portuguese, so it makes me European.
My first doubt is, I am living in Brazil at the moment, my wife is pregnant for 5 months and she is Brazilian. We are planning to live in London, if she has the baby in UK, will the baby be British ? And what about her, can I give her my European citizenship if we get married in UK ?

Please guys, I need a fast reply.
Thank you very much.

Baby will not be British automatically. If you use the EU excercising treaty rights route to the UK on your Portuguese passport, once you obtain Permanent Residence after 5 years, the child will be entitled to register as British Citizen on form MN1 under section 1(3) if born in the UK.

Your wife can apply for a EEA Family Permit and she will also have to complete 5 years, with you EU excercising treaty rights in the UK to gain Permanent Residence.

Thank you very much for the information.
Just one more question, will my baby have the child benefits before he becomes British after those 5 years ?
