10 Year ILR Query

Post by m.asif » Tue Jan 21, 2014 10:37 pm

Hi

I am currently on TIER 1 General visa and will be applying for ILR on 10 year basis. Can someone please clarify points.

1- Which form I need to use. FLR (LR) or SET (LR) ?
2- Which form my wife need to use once I got my ILR?
3- Is there any maintenance or minimum earning requirement need to be fulfilled when she will apply as my dependant?

Thanks

Thank you CR001 and Amber for such a quick response.

My wife was initially granted Tier 1 (PSW) dependant visa in November 2009. Her last visa was granted in August 2012 as Tier 1 (General) dependant.

Can you please also clarify whether she will need to complete five years in UK to apply for ILR or she will come under 2 years rule?

She'll need to show adequate maintenance and accommodation, basically if you're working, 3 months wage slips and corresponding bank statements. A1 English requirement for FLR(M). It will be under Part 8 of the immigration rules, thus, 2 years. She should, on the face of it, be able to apply for settlement, SET(M), as soon as FLR(M) is granted by virtue of rule 27087(a)(i)(d). LIUK and B1 English required for settlement.

Thank you Amber.

Just want to clarify couple of points from your last reply.

1- As you mentioned in your reply, for FLR(M) she will need AI and for SET(M) she will need B1 level to fulfil English requirement. In this case if she passes B1 level would this be sufficient for both applications?
2- As I'll need to show the maintenance/earning, what is the minimum earning/requirement in figures?

Thank you in advance.

sabrinoman, you can make your post anonymous and put it on this forum.

m.asif, with 2 children, you should show approx. £262 net per week income (after deducting rent). Remember, once you are granted ILR you can claim Child Benefit and Tax Credits, both of which can be included in 'income'.

Just don't include anything with personal details. Or if you do, change the names etc...
