Advice on my Aus partners Visa please..

Post by jockmonsta » Tue Feb 03, 2015 3:01 pm

hi there,

very briefly, I'm confused at all the information and what actually pertains to me exactly.

I am a UK and Australian citizen, I've lived in Aus for the past 17 years, decided to come home (to scotland) I've bought a house and opening a small business in the town i live in.
my fiancé who I've been with since 2005 has now joined me (on a 6month visitor visa) as at the time i was unsure if i wanted to remain in the UK,
We have an 8 year old daughter together, she has Automatic eligibility to apply for British citizenship? who is in school and settled in.
we are getting married here in Scotland very soon, now my question is, what visa should my partner apply for? i don't want her to have to leave her daughter and our new home for 3 months as she would have nowhere in Aus to go to, also, i need her invaluable help in setting up the business, I've read and been told so many contradicting things.

If anyone has been in our situation or similar, we would welcome your advice

cheers

Your partner cannot switch to any visa category while in the UK on a visitor visa, it simply is not allowed. I would question whether you would have any problems getting married as your partner is not on a marriage visitor visa or fiance visa.

He needs to return home an apply for a fiance visa.

The tough part is you'll need to show earnings of at least £18,600 pa for the last six months, or have savings of £62,500..

Even tougher, because you appear to be self employed meeting and proving the financial requirement is much harder, needing accounts etc.....

To be honest marrying in Australia sound best option in this case. And then she can apply for spouse visa? Unless it opens up financial requirements Appendix 2?
