Any time limit on travel after spouse visa issued?

Post by spring123 » Mon Feb 16, 2015 3:01 pm

Hi guys

As some of you may know, my wife has been granted a spouse visa. Her visa ("visa 1") appears to be have been granted for a period of 33 months.

Is anyone aware of any time limit for travel to the UK? In other words, can she wait in India for a couple of months and then travel to the UK?

Even if there is no requirement as such, is there any other reason why she should choose not to delay her travel?

The only thing I can think of, is that she'll have to renew her visa once anyway after 33 months, and if she then gets issued a visa ("visa 2") for 30 months, then that leaves her with 3 months' spare to be eligible for indefinite leave to remain (60 months).

So if she delays her travel by more than 3 months, then she won't be eligible for indefinite leave to remain when visa 2 expires. This will probably mean we need to pay for, and extend her visa again.

Let me know if you have any advice, thoughts or personal experience in this respect.

Thanks

Thought!

You haven't considered any other holidays for the periods of 2 visas. Are you sure spouse wont leave UK for further absences?

Secondly what if the rules/laws changes by the time you want to apply post visa 2?

regards

The extra 3 months on visa 1 is to allow the spouse to travel with some flexibility. My suggestion would be is to make sure she is in the UK at the start of month 4 at the latest as then she will do her extension for visa 2 and meet the 5 year (60 month) requirement.

Thanks guys.

I think there's an allowance of some 180 days of holiday out of the country in the 5 year period?
