Tier2 situation

Hi All,

I came here last Dec. under Tier2 General visa sponsored by my employer, however my employer wants me to move to US the thing i don't want to do. In this case I'll lose my job and have redundancy package. I am looking for job now with company that can sponsor me. The thing is I don't will to leave UK if i don't find job or stay for longer time till i find job. Can i switch ti Tier1 ? I heard that it will be discontinued ,, is there any other option to support work here without the need of sponsorship ? How much dose it take for government to know that I lost job and send letter to me ? any help is appreciated

Tier 1 General is no longer available, not sure about T1 ent or T1 inv, which require large investment etc.

For work visas, with the exception of UK Ancestry, you have to have a sponsor.

If you lose your job, your employer will notify HO.

Thanks for reply,, Any idea how much dose it take HO to process the notification ? I mea how much time do I have since the day my employer terminates me ?

Probably about 60 days.

Is there a mobility clause in your employment contract?

When you are terminated the sponsor must inform the HO within 2 weeks. Your visa will be curtailed to 60 days from the date of the HO decision to curtail, not from the termination date. How long the HO will take making the curtailment decision is anybody's guess but it could be 1 month in which case you'll have 3 months in hand. Note that you can overstay by 28 days without having an impact on your immigration status.

Also note that before assigning the CoS the new sponsor will have to carry out a RLMT (unless you are a high earner or the job is shortage occupation) which takes 28 days.

Thanks for answering. I don't think that there is any kind of mobility closure on my contract. Just to make sure that i understand you, I can stay for extra 28 days after 60 days curtail ends (total of 82 days) ?

60+28=88 days from the date of curtailment (which will be some time after the date of termination)
