Wifes Visa rejected-SOS!!!!!

Post by gkrahulmenon » Thu Apr 09, 2015 9:40 pm

Hi -I am living in the UK on tier-2 general visa and had applied for a visitor visa for the wife. The list of documents i had submitted includes my BRP copy, passport copy, bank statements(last 6 months), invitation letter, her travel Itinerary (air tickets- to and fro) , letter from land lord and Employment letter. My wife had submitted the marriage certificate form her side. We got a rejection after two weeks stating that the ECR was not convinced that i would be supporting her in the UK and she might overstay in the UK. This is was conflicting as i had clearly stated that i would cover her expenses while she is in the UK in the invitation letter. I do realise that we did not provide any evidence of my wife's property, assets or her financial situation, could this be the reason for refusal. Although I had provided my bank statements.

Also is there a cooling off period for application of the tier 2 dependant visa once you have been in the UK on visitor visa.

We are planing for a re-application as we do not have any other option. i have been warned that an appeal takes ages for a resolution.

The consulate concerned was Chennai.

Can some one out there pls advise.

Yes, she would have needed to prove her ties to home country, which she did not. Why didn't she apply for a Tier2 dependant visa?

Risk of refusal again though as a visitor. There is no cooling off period as you have asked. A better option would be to apply for a Tier 2 dependant. The refusal of the visitor visa will be on file now.

What was the exact readon for the regusal, can you quote the relevant text without personal information?

I agree, you are better of waiting until your income mature, otherwise she risk a refusal, as they will conclude she is likely to stay with you and not return.
