Spousa visa

Post by HarryC » Fri May 22, 2015 2:36 pm

Hello

I am going through a divorce but most likely it wont be finalised till end of July. I will be going to apply for Naturalisation on 10th june using NCS. I have currently got indefinite leave to remain. I am planning to remarry in Sept in India and apply the visa for my spouse.
my question is, If my naturalisation application isnt processed by September (by any chance) OR even if it has been processed but i dont attend the ceremony till i am back from India, whilst i am india, can i apply the visa for my spouse using my Indefinite leave to remain status?

thanking you in advance
harry

It is the same visa for a spouse whether you are British or have ILR. Make sure that you have the decree absolute before you get married.

Yes you can apply for Spouse visa using your ILR. It is worth to get naturalisation certificate before submitting spouse visa application. That will make your application strong.

Having British Citizenship won't strengthen your application. It all depends on the validity of the documents your submit and whether your application meets the Rules.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
