Fiancé visa

Post by sy2012 » Tue May 26, 2015 7:43 pm

Dear All,

This forum was really helpful when I was applying for my ILR (that was in 2012) so I'm returning here to get your advice on how best to progress for my fiance's visa. We've got engaged last month in India and the marriage is in November this year. My fiance is in India and has never been to the UK.
I've done some search and found that the ILR dependant visa processing times are almost 60 days or more. Based on experience please could you suggest if I should get a fiance visa now so my fiance can join me immediately after marriage and we can then apply to get the visa to ILR dependant in UK or have the visa processing times been improving? I could wait 3-4 weeks after marriage if the visa will be processed within that time.
Also, I moved to ILR from Tier-2 ICT visa in 2012. Does that make any difference to what category I should apply my fiance's dependant visa in?

Please provide your suggestions.

Thanks

Best Regards,
sy2012

A fiance visa is for when you want to get married in the UK.

From your post, I understand that you are getting married in India. You will therefore have to wait till you are married and apply for a spouse visa.

Your previous status as a Tier 2ICT is of no relevance for the purpose of your impending marriage as you can only apply for spouse visa of settled (ILR) person on VAF4A and meeting the financial requirements and your future spouse must meet the English A1 or degree and Naric etc.

Thanks CR001 for the clarification. Would you by any chance know if the processing times remain same throughout the year or there are times when visas get processed quickly? I tried to look at data for various places but couldn't conclude anything.
