Future after British Passport

Post by dvadithala » Sat Jun 06, 2015 9:29 pm

Hello Experts,

I've recently got my British Passport through Tier 1 route. However, my long term plan is to move to US as most of my family live there. Currently, my wife is on dependant visa until 2019 (then she can apply for ILR). I wanted to know what will happen if we move to US with my British Passport status? What if I settle in US and return to London, will that effect my British Passport at all?

Any advice is greatly appreicated.

Thanks in advance.

Cheers,
Me

No, it won't affect your British Citizens status and you can get a US work visa if you qualify.

It will affect your spouse's status though and qualifying for ILR as she might struggle to apply to extend her PBS Dependent visa from abroad in October 2016 and would have to apply for a spouse/settlement visa which will be a new 5 year route to ILR to return to the UK.

Also, if you move once your spouse has ILR, if she is absent for more than 2 years, she will lose her ILR status.
