FLR for T2 Partner visa - spouse now naturalised

Post by inzogbiya » Thu Jun 25, 2015 7:39 pm

Hello

I have recently been naturalised (I used to be on Work Permit then T2 then settlement then naturalised).

My wife is currently on a T2 Partner Visa. She's been on this visa since she first came to UK in June 2013 and her visa is due to expire on March 2016. My understanding was that her T2 Partner Visa is still valid even though I have been settled and now naturalised.

I'd be grateful if someone could answer the following 2 questions:

1. Which form should she use to extend her current leave, which will expire in march 2016, so that she's eligible for settlement after 5 yrs.
2. Once she's eligible for settlement, is it SET(O) or SET(M) that she should use?

Many thanks for any responses.

1. She can continue to extend on PBS Dependent Form (Click) until she meets the 5 year residence requirement

2. Set(O)

She will also have to pay the new IHS Surcharge (Click) before she submits her application to extend.

Just few more queries on the application forms please:

For PBS Dependant application form:
1. When they ask for nationality of the PBS main applicant and reference number for the most recent application of the PBS main applicant, does she declare my nationality as British and include the HO reference number used in my naturalisation application?
2. For maintenance funds, does she proceed on the basis that the PBS main applicant is a T2 General Migrant?

For SET(O) application
3. Does she need to provide any SOC code/salary details now that I have become naturalised? Should this be left blank? I should note that she currently works as well.
4. I assume as a PBS dependant she doesn't need to provide evidence of any absences even though she's working herself.

Many thanks :)

If a dual citizen, you can list both. If you have lost your birth country nationality, then put British.
2. For maintenance funds, does she proceed on the basis that the PBS main applicant is a T2 General Migrant? Yes

For SET(O) application
3. Does she need to provide any SOC code/salary details now that I have become naturalised? Should this be left blank? I should note that she currently works as well. No SOC needed I think.
4. I assume as a PBS dependant she doesn't need to provide evidence of any absences even though she's working herself. Correct although absences should be limited and for good reason, i.e not 8 months in home country and 4 months in UK every year for example.

Many thanks :)
