Hello

I have received a D-Spouse visa /CP that will be finishing in July 2017. I wanted to know what I would have to prepare as evidence or letters to apply for the next visa and what form will I have to fill (My wife is British, I am living in my mother in law's house so I am not on any of the house bills and I also have two babies who were born in the UK). If I am not wrong the next visa will also be for another 2 years 6 month, and then what will be the next visa steps so I can apply for a British Nationality.

Also during the visa that I am holding, is it right that I can only leave the country for 90 days each year?

You should have cohabitation proof - letters at the same address.

After 5 years on spouse leave under Appendix FM, you apply for settlement on SET(M).

Citizenship would require ILR aka settlement.

There is no 90 day absence allowance, each case is judged on its own merits.

Thanks a lot for your quick response.

Would you have any link to an exhaustive list of proofs we will have to give when my actual visa runs out. I have heard that not all letters in my name and coming to my address are counted as poofs (like phone bills and letters from friends and family).
Also is there any restrictions then about how many days I am aloud to leave the UK each year and under what circumstances these travels can take place (professional or also personal?).

Letters can be addressed jointly or to each of you individually and they should be bills etc, not letters from friends and family.

There is no absence limit as such, however absences should be limited and for good reason, particularly if long absence. You are free to travel and all absences, professional and personal, are classed the same.

For ILR on Set(M) when you get to that point, only absences of 6 months or more need to be declared as the rules currently stand.

Thank you for your help. I have been reading the form and they say:

If you and your partner lived with relatives or friends for some or all of the 2-year period, please
provide a letter from the relative(s) and/or friend(s) confirming this.

Does this mean you are exempt from giving letters confirming that we have been living together in that case?

I think that your friend's or relative letter would excuse you from providing utility bills, which presumably wouldn't be in your names. However, I think you should provide other evidence as suggested on the form.
