ILR Dependent

Hi All,
I'm on Tier 2 General Visa (exp -July 2016) and eligible for ILR towards end of Aug 2015. My Husband is on Tier2 dependent visa.
My questions are
1) Does my Husband need to apply for ILR Dependent Along with me Or Is it OK if He continues on Tier2 dependent visa until its validity i.e.end of July 2016 ?
2) Also If he can continue on his Tier2 Dependent visa , does he have the permission to travel outside the country ?
3) What is the consequence of not applying for ILR dependent this year,As the rules for the same will be changing in April 2016?

how long has he been in UK , as your dependent? If he has been long, then he MUST not change to ilr dependent as that will reset his clock for settlement.

1. he does not have to, he can continue as your dependent. In fact, once his visa is going to expire and if he is not eligible for settlement he can extend his leave as a PBS dependent.

Hi,

Many thanks for the response.

1) He has been on Teir 2 dependent since Aug 2013.

2) My understanding is there are going to be changes to rules regarding settlement from april 2016. wanted to know how it would affect my husband.

3) Any suggestion as to what should he do in the current seniro mentioned in the previous post as we do intend to travel asap i get my ILR.

the proposed change in ILR is for the main applicant.
You should get your ilr, and your husband should continue on his dependent visa. He should extend his Tier 2 dependent visa before it expires (sometime next year) and once he has been on tier 2 dependent for 5 years, he can apply for ilr.
There is no problem in your travelling.

Once again many thanks for the quick response.

I have a Child who is born in uk in 2013. does'nt have a uk passport. as mentioned earlier we are intending to travel by the end of oct 2015. what is the best route i could take for her 1) apply for depenent visa (ILR dependent) or 2) apply for british passport once i get my ILR.

is there a short term dependent visa that i could apply for her?

please advice

UK born child is entitled to register after a parent is granted ILR.

How dependent can continue with T2 dependent when main applicant gets ILR. As far as I am aware of, dependent is always dependent on main applicant. If there is any change in main applicant, dependent status will also change. E.g. if main applicant's visa is curtailed for some reason then applicable for dependent too. why not same applicable when you get ILR ?
My understanding may be wrong here, but wanted to understand how does it works - when there is change of main applicant getting ILR, but dependent continue as T2 dependent ?

Hi,

Please guide, i am on an Tier 2 (Genaral Visa) which expires Aug 2016. I have a kid who is born in here and we wish to travel to india in November. What is the best Visa that i could apply for her and what documents are required.

Tier 2 General Dependent is the only visa you can apply for the child as the status is based on your visa status.
