Tier 1 Ent and being out of the country - UK

Post by n8net » Thu Sep 17, 2015 11:46 am

when we go for Tier 1 ent. Extension, is there any limits on numbers of days you can be out of the UK.

reading the guidance, I cannot find anything, also if you eventually go for ILR (after the intial + 2 years of extension - the 5 year ILR rule ), I know you need not be out of UK for more than 180 days in any calendar year prior to the ILR application date.

is it still the case ?

also what does the "continuous period" rule say for the 10 year long residence ILR application

thanks

It is 180 days absence per 12 month cycle that is allowed for ILR based on PBS 5 years. The 12 month cycle is counting backwards from date of ILR application.

For ILR based on 10 years residence, no more than 540 days absence in the whole 10 years and any absence of more than 180 days (6 months) breaks continuous residence.

Yes, absence of more than 180 days in any 12 month cycle break residence continuity.
