TIER 2 ILR WITH 5 YEARS ROUTE

Post by FK2016 » Sun Jan 03, 2016 4:04 pm

Hi Guru's and members,

I wonder if you could help with my questions here?

I was Tier 2 General dependant between 24/04/2012 and 01/04/2015 (overwritten by new visa starting off in 2013) than become Tier 2 general holder myself (and wife become dependant) between 19/11/2013 and 11/12/2016. At the end of this year (2016) we will need to apply for 2 years extension and will continue through standard 5 years continues ILR route (if the rule doesn't change before than). My question is do we have to wait until end of my 2 years extension period before being entitled to follow 5 years route? or the time I spent as tier 2 dependant (24/04/2012 and 19/11/2013) is that being counted through 5 years which than could mean i can be entitled to apply ILR before the end of 2 years extension?

Not sure if that is clear enough question but i will highly appreciate your guidance here.

Memo: Snapshot of what I explained
I was tier 2 dependent between (24/04/2012 and 19/11/2013)
Tier 2 Main holder with 3 years visa (19/11/2013 and 11/12/2016)
Next up - 2 years extension period will be (Dec 2016 and Dec 2018)

Many thanks and happy & blessing 2016

You cannot combine PBS Dependent and PBS main applicant time to make up the required 5 years.

You will need to wait until you have 5 years residence in your current visa category.

Many thanks for the quick answer. It seems i was mistaken and don't remember where did i get the idea might have been rules based in 2010 when i was on Tier 1 PSW. Never mind have wait until see the light at the end of the tunnel by Dec 2018 (ironic it works about the same time with my 10 years long residency completion time which is going to be end by Oct 2018 but tier 2 more sound route especially with dependants.

Cheers again, appreciated.
