I was on Tier 1 general visa and got my ILR on 17/11/2015.
My wife went to India in July 2015 as she was expecting. She is on Tier 1 general dependent visa which expires in March 2017. My elder son (who was also born in India) is also on Tier 1 general dependent visa which also expires in March 2017.
My wife gave birth to our younger son on 16/11/2015 (1 day before my ILR) and we are in the process of applying for our younger son's visa on next Tuesday (22/03/2016) from India under family of settled person visa category.
we are applying under family of settled person visa category but I read a recent post highlighting a visa rejection under this category (I guess because the application was made under incorrect category) and also saw some posts stating that there are two option either to apply under family of settled person visa category or Tier 1 General Dependent visa category.
I would be really grateful if senior members could shed some light on this and advise whether should I cancel the appointment for application under family of settled person visa category and apply Tier 1 General Dependent visa category.
