PBS Dependant ILR eligiblity

Hi,

I have entered UK in Feb 2011 on ICT Tier 2(long term) visa. i then converted myself to Tier 2 general PBS dependant in March 2014. now the my main applicant is eligible for ILR in April 2016. will i be also eligible for ILR along with my main applicant or do i have to wait and take a visa of some other type.

appreciate your help on this.

Was the Tier 2 ICT (Long term) your own visa as main applicant or were you the dependent?

If you were not a Tier 2 ICT Dependent, your qualifying time for ILR starts in 2014 when you changed to Tier 2 G dep and you will only be able to apply for ILR in 2019 after 5 years Tier 2 G dependent residence.

Thanks for the reply,

My Wife has now got ILR, what is the best visa for me to continue on to the quickest path to ILR?

I did some research and it looks the PBS dependant will be the one.

But if i go with PBS dependant and if my wife changes employer will it impact my visa status as the initial COS(certificate of Sponsor) will terminate.

PBS dependent is the quickest route. There is no other route that is shorter.

Your wife is no longer tied to her employer as she has ILR.

You are dependent on your wife NOT her employer so there is no impact on your visa if she changes employment. The rules permit you to continue as PBS dependent until you qualify for ILR. This is provided that your spouse has not applied for ILR based on 10 years long residence.
