Tier 2 ICT (Long Term) to Tier 2 General

Hi,

I have read the forum for similar topic and check the 74 page TIER 2 document as well.
However, I haven't found the solution for my query.

I have a TIER 2 ICT Long Term visa with which I came to UK in Jan 2015. It was initially given till March 2016, and it has now been extended upto Oct 2017.

My query is
If I get a job offer with another employer who is willing to sponsor me.

1. Can I go to my home country, apply for TIER 2 GENERAL with that sponsor with CoS while being in Job with old employer, then come back to UK, serve Notice period with current employer.
Once over, start job with new employer under new CoS. ?
Will the cooling off be applicable in this scenario ?
All this being done before I leave the current job and within the validity of the current ICT visa.

2. I resign from current job. After serving NOTICE, I go back to my home country and apply for TIER 2 GENERAL with new employer, come back to UK and start work.
Even though, I have left the job, my VISA is still valid till Oct 2017.
Will the cooling off be applicable in this scenario ?

12 month cooling off period will apply and is counted from the date you leave the UK.
