Tier 5 GAE Eligibilty

Post by pejict » Mon May 09, 2016 9:06 pm

I'm currently holding Tier 5 YMS working for a company,
At the moment we are trying to extend my stay for a short period.

We found this scheme called Tier 5 GAE internship and it seems quite suitable for us.
I can see there are many organizations are able to help of being a sponsor for a migrant but some of them have different eligibility criteria, Especially I found this one that require their candidates for
"Must have completed their studies within 3 years"

This worries me the most as I finished my study 4 years ago.
From the other side some of the others don't list this as a requirement.

I just want to know what the truly eligibility criteria is? Based on Home Office' website it only says I need CoS and proof of saving :(
Or let's say all these eligibility criteria can be varied by different organizations?

In addition, does anyone know that is Tier 5 GAE can only be applied once in a lifetime?

Thanks guys for your kind help!

You don't qualify (i.e. don't have a qualifying visa) to switch to this route.

HO make the rules and set the requirements you have to meet, not the sponsor.

Hi,

Thanks for getting back!

I think that I'm not going to 'switch' to this Tier 5 GAE in UK, what we are planning to do is we get everything prepared and then when my current visa expired I will fly back to my country of residence to apply for this.
So I feel what matters is, am I qualified to get a CoS from a Tier 5 GAE sponsor?
As I know that as soon as I submit the application in my country, then I should be able to hear back the decision within 3 weeks which is okay for our company.

Do I misunderstand anything?

Tier 5 GAE is more than likely to be refused in your given circumstances. It is not designed for your intended use and more to the point trying to return to the UK after YMS in the way you suggest is going to raise concerns. It is pretty obvious that your intent will be to extend your stay to carry on employment which brings into question your entire credibility.

By all means try if you wish but expect it to be refused.

As a footnote the various Tier 5 GAE schemes all have differing conditions to qualify. They are the sponsoring organisation and as such they decide if you qualify and wither to issue a COS. It is not a case of you wandering up and saying please issue me a COS please. And be aware there is usually chunky admin fees for Tier 5 GAE internship schemes as that is how they make their money.
