Help

Post by xoheb786 » Wed May 11, 2016 2:06 pm

Hi, I just want to ask something if it is possible or not. My mom's mother and father both were British and they both passed away in 2007 and 2010 respectively. My mom was born in Pakistan in 1959 but never applied for British passport and she had never been to UK untill 2013 when she came on a visit visa on my wedding. I came to UK in 2010 on a student visa and got married here. Is it possible my mom can apply for a nationality?

Thanks

Were they British at the time if your mother's birth?

Needless to say your grandparents were married?

Yes, they were married but no they were not british when my mom was born. They got british passport in 1975.

Also my mom's yonger brother and elder sister both are British. It's only my mom who never applied for British passport.

She may qualify for ancestory visa, but not citizenship.

She was not a British at birth.

Through what route did they obtain citizenship?

Also, what route did your mothers siblings obtain citizenship?

That thought also crossed my mind, which was why I put may qualify.

Thanks for clarification. The rules changes ever so frequently, and one has to be putting may on topic that have not been visited for a while.

Interestingly though, Ancestry visa is the ONLY visa category that has not had any changes in rules or requirements since the change a few years ago from 4 years validity extended to 5 years validity in order to make it simpler for ILR without needing a 1 year extension.

Unless you can answer this question, no one can advise if she would qualify for an Ancestry visa (which is an employment visa by the way)

Then the Ancestry visa is not an option at all for your mother.

You need to try and find out how your mother's siblings obtained citizenship and why your mother was not included in this process. Did her brother and sister live in the UK with their parents?

I just asked my mom and she said her sister obtained british passport through her husband but her brother obtained british passport through my grandparents and he lived with them as well

Then there is likely no avenue for your mother as your brother likely 'piggy backed' on their citizenship application.
