Evidence of financial requirement

Post by Lforrest333 » Wed May 11, 2016 4:29 pm

I am applying for a marriage visa. My husband is British and we were married in the uk in December last year. I have been in the uk on a Teir 2 (sponsored) visa since 2010 and have been permanently employed for the entire time. I earn over the £18,600 requirement. My question is does my husband have to supply proof of his earnings seeing I already earn over the requirement? He is self employed and the evidence needed will take us some time to compile.

Can anyone help me?

Many thanks

Any reason you are not applying for ILR based on Tier 2 General with more than 5 years residence in this visa category?

I wish to have more flexibility with work. I may want to work elsewhere.

Your earnings alone will qualify.

Once you have ILR, you are free to change employers.

FLR(M) spouse visa will reset your clock towards ILR.

why does the guidance for ILR say, "You must still be required by your current Sponsor in the role recorded on your Certificate
of Sponsorship for the foreseeable future"?

Also I wish to work only part time so I will not be earning as much as the threshold specified for ILR.

If you already qualify for ILR based on Tier 2 General, you only need a letter from your employer stating that you will still be required for the foreseeable future. HO don't check on if you have resigned after getting ILR, it is irrelevant really as you are free to work for anyone or not work at all once ILR is granted.

Your choice to switch, but seems a waste considering you have been in the UK on a ILR qualifying visa for more than 5 years.

For FLR(M), don't forget the £500 immigration health surcharge you need to pay before you can submit your application.
