Tax credits

Post by Neilam » Thu May 12, 2016 10:18 am

hello, I would love some clarification so I can finally put this to bed and move on as to if my husband is Egyptian and we will be applying for uk Spouse visa in Nov which I when I will be ready, will it affect our application if I am claiming tax credits? I was working part and went full time in April in order to meet the financial requirements which were not enough but am making up for it in savings, I have a daughter from a previous marriage so have been receiving both work and child tax credits, I have called tax and informed them and when I asked them they said it's complicated however if I'm entitled then this should not affect the visa application, I am aware of single claim for now and joint claim for when he comes, I have read so much conflicting answers that I really just need to know so I don't feel so overwhelmed. I would appreciate any guidance on this matter. Thank you

It should not affect the spouse visa applications. You cannot use the tax credits to count towards the financial requirement.

What is your full time annual salary?

How much savings do you have?

My salary as of April was 17,560 and I have put £20k in a savings account last month too which is from a propert I sold in Aug 2015 which was in a current account and I told tax credits about this, as far as I have understood this means I should be ready in Nov 2016 to put the application if I have my 6 months pay slips and bank statements? I don't need to wait for a full year and give my p60 to show I have been on my new salary for a year? I am still with the same company which I've been with for four years and I was part time up until end of March 2016

Yes, 6 months is sufficient if your lowest wage during that period equates to the financial requirement you are relying on, e.g. Lowest monthly wage slip x 12 = what you are relying on. The first £16,000 of savings is ignored. See, https://www.gov.uk/government/uploads/s ... t_2015.pdf

Lowest monthly wage = what I am relying on? I'm not sure what that means? If net pay is for example £1200 on my wage slip, then X 12 = £14,400.. So that's the amount the visa officer will look at and not that I am employed at £17,560pa?? If that is the case then how much should I have in cash savings?

By my calculations you will need to have held £26,500 in an accessible account for 6 months.
£14,400 earnings = £4,200 shortfall (£18,600 required).
£4,200 x 2.5 = £10,500
As the first £16,000 of savings are disregarded £16,000 + £10,500 = £26,500

Edit. I see that you've given your net pay. So it may not be as bad as you think as it's the gross pay before tax/NIC deductions which is taken for the calculation.
