Tier 2 General Dependent to Tier 2 ICT

Hi All,
I am on Tier 2 ICT from March 2012 and this is my fifth year now in UK. My wife got Tier 2 General now. If I convert my visa as Tier 2 general dependent and continue in my current job, after 1 year , can I apply for tier 2 ICT again, if I work for the same employer?

If yes, can I apply within UK or do I have to go back to India?

You can only apply for Tier 2 ICT if you have been working for the sponsor in your home country. You can't 'switch' to Tier 2 ICT with 12 months UK working for the sponsor.

Why, if I may ask, do you want to keep switching categories? You are permitted to work as Tier 2 G Dep for any employer.

Thanks for the clarification CR001.

We have a fear that my wife's T2G visa may be cancelled , as it's a small company and visa depends on the projects they get in future.

Anyhow we are going to complete 5 years, If we manage to stay for another 5 years, we will be eligible for ILR in 10 years route.

If I complete the ICT cooling off as T2G dependent, could you please suggest what are all the other options available , just in case.

If you switch to Tier 2 General dependent and wait 12 months in this category, you can then apply for Tier 2 General from home country. Your sponsor will have to complete the full and proper RLMT process to prove to HO that you have not been pre-selected for the position.
