Tier 2 ICT more than 5 years visa & ILR eligibility

Post by v007 » Thu May 12, 2016 3:26 pm

Hi All,

Here is an situation i am in for which i am getting different responses from different people.
I need your expert views on this, so that i can investigate in correct direction,

I came to UK in 2011 on ICT (Intra Company Transfer) visa and following are the visa changes i have had since then,

Initially i had 'Tier 2 (ICT) Established staff'
Valid from - 26/04/2011 to 14/05/2014 -- 3 Years

Then i was moved to Long term visa and the details are as follows,
Tier2 ICT Long term leave to remain
Valid from- 01/01/2014 to 14/01/2016 - 2 Years

Then my visa was extended for another 2 years
Tier2 ICT Long term leave to remain
Valid from- 01/01/2016 to 14/01/2018

I have been told that I will get another 1 year of extension on same category Tier2 ICT Long term leave to remain as it will complete my 5 years
on Tier2 ICT Long term leave to remain.

So in short i had,
3 years (Tier 2 (ICT) Established staff) + 2 Years (Tier2 ICT Long term leave to remain) + 2 Years (Tier2 ICT Long term leave to remain)
And potentially i will get another year extension on Tier2 ICT Long term leave to remain.

So my question to you guys is, am i eligible for ILR at all?
Or is my visa can be extended unlimited but i dont get ILR / settlement?

I would need your help / views on this as i am getting mixed feedback from different people.

Reg,

Tier 2 ICT applied for after 6th April 2010 does not lead to ILR.

Read point 28 in

https://www.gov.uk/government/uploads/s ... 4_2016.pdf

As I understand, there is no limit on your extensions as long as your company is happy to extend.

To attain ILR, you may need to -
1. Switch to Tier 2 General and apply after 5 years (or)
2. Continue with the same sponsor till you complete 10 years(Long Residence) of your stay
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Thank you poper very much for your exact answer.

Can you please validate my below understanding,

So i can get unlimited extension on my Tier 2 visa as long as my company is sponsoring me?

and to be able to apply for ILR
1. either i have to switch to general visa category and after completing 5 years on general visa i can apply for ILR (Which is effectively 10 years from start, 5 i have already completed and 5 i have to complete on general visa)

2. or i have to continue on the same Visa with same sponsor for another 5 years and then i can apply for ILR.

Can you please validate my understanding or correct it if it's wrong?
