Hello,

I would be extremely grateful if you could advise what are my options in the following scenario (apologies if this has been already asked).

I have just had my ILR granted. My son who is 8 months old was born in the UK and doesn't have ILR. We decided to register him as a British Citizen therefore didn't apply for ILR for him. I now have to travel with him before returning to work in August 2016 (i am on maternity leave). However, it looks from the MN1 timeline that the process could take up to three months or more. This will mean that by the time we may get his passport my maternity leave will end and I won't be able to travel. My question is can I travel with my son while his MN1 form is in process? Does the Home Office issue any travel document to allow him to travel with me? If so, will this affect his application?

He can travel, he might have a problem coming back though as he won't have a visa and might not be British at that point yet.

Home office won't issue a travel document as he is not stateless.

You should apply for a foreign passport (your nationality) for your child to travel.

+1 on Ms CR001

One of the option could be to apply for MN1 straight away using joint application and he can fly back to home country using foreign passport. The British passport will come automatically after the MN1 approval and dad can carry that passport to back home and all of you can travel together. This may still take roughly a month or so depending on when you get a biometric letter.

Many thanks for your response. Can I just double check that I understand what you are saying (sorry just for my own 100% understanding). Are you saying that we can apply for registration as BC through MN1 and passport at the same time and can travel with a passport of his current nationality while the MN1 and BC passport is being processed? My husband can then send us his BC passport for us to return to the UK?

Yes.
My husband can then send us his BC passport for us to return to the UK?
I'm not sure if he can post it. Someone may have to carry it by hand with your consent. It may be worth checking if courier can carry it or some seniors may be able to comment on this.

It was for a child so couldn't stop myself from searching a bit more and if it helps you in any form..

Thank you every so much. Very kind of you. I will go through them. I have consulted my solicitor today and the options forward are A) apply for a foreign passport then ILR or b) apply for a foreign passport (current nationality). and BC at the same time, get the biometrics done, and travel with the foreign passport and return with the BC if granted before we decide to come back. Thank you again.
