What can I do during 28days advertising to secure the role?

What can I do during 28days advertising to secure the role?

I am working in the UK, holding a tier 2 general visa.

I recently got an offer from another company by directly called by the person in charge, who is my previous colleague.

As he doesn't know the process of changing sponsor, he later found that the company didn't post the role online, so they are now initiating the advertising in order to pass the 28-days RLMT.

At the meantime, I also be recommended by a visa application consultant that I'd better apply the job again during the 28 days of advertisement to ensure the UKVI will not use it to decline my application.

So my questions are:
1. Do I really need to reapply for the role?
2. If I do have to reapply, do I need to go through the interviews again?
3. Can I get an offer letter and contract before the 28 days ends so I can secure the role?
4. Is there any way that I can secure the role during the advertising period?
5. I've been through their company website to see other roles but found no salaries are stated. But my understanding is that the salary is a must in the job advertisement. Am I right?

I am also a bit concern that, at the moment, my new boss is already suprised that there are so many things to do to recruit me. If I mention about reapplication for the role and probably go through the interview again, I am worrying that he could got scared away and withdraw from it. So should I mention it at this point?

I really appreciate if anyone can give me some ideas.

Sounds like you have been 'pre-selected' for the position and that they are only doing RLMT to follow process.

Assuming of course it is an approved sponsor.

Hi,

To be clear, I am not pre-selected. They said they are interested, but still interviewing other candidates. Surely they are reserving the right to say no at any time.

I am asking these questions and said I've been offered based on the most optimistic assumptions. Sorry for the misleading of the context.

You would need to apply to prove you have not been 'pre-selected' or approached 'before RLMT' is complete.

You should only be offered a contract etc after the RLMT process and the employer will have to submit the supporting evidence on who and how many applied and why they were not suitable as EU or British citizens or persons with ILR/settled status.

This is important to clarify

I agree that we can not get an offer before
Rlmt is conducted but do we need to apply
During rlmt

I doubt this is mandatory

I gave interviews before rlmt and they told
They are interested but they did not have any
Offer and conducted rlmt

After sometime then I was given the offer

Please confirm is this is a problem as I will
be applying for visa soon

@bholo: How can you apply for a position that was not formally available (i.e. before RLMT)? This is a logical question that HO may also ask. I think this may create doubt in case worker's mind of RLMT not being conducted as per process.

The job was initially placed on website only and remained
There for months as they could not find anyone

Then I applied and told them I am on tier 2

Once I finished they said they are interested but
Can't confirm anything as they are going to do rlmt

T rlmt was then conducted and then I was being
Told that they need further 2 weeks for a decision

Two weeks after that I was being told that no
Suitable candidate was found so they will like
To go ahead with me

Not all jobs after re gone through rlmt unless
They do have someone who they are interested
In and needs tier 2

Please confirm why this is a problem

Also how does case worker know any way when
I applied and even if he knows I have only got
Offer once rlmt finished after rlmt finished
And no suitable candidate found

Two points to consider (from UKVI perspective)

1. Were all the other candidates deemed unsuitable because the employer has already decided the role will go to you.

2. Is the role so obscure or specialist no local candiates were genuinely suitable.

Jobs are hard to find and there are plenty of good people about, local, EU and immigrant, I would find it hard to believe point 1. couldn't be satisfied and if we accept that, and take point 2., why is the role not on the shortage list?

This is what the sponsor has to prove to UKVI and it's never easy in these circumstances where there is an element of pre-selection.

The role is an info sec role
It is available now in shortage occupation but only
if company is a qualifying company and over
5 year of experience

I like the way you used term element of pre selection
L rather than selection

I have seen my cos which simply states dates or rlmt

How with this information are ukba going to make
Decisions about when I apply

Never the less what do you suggest in present scenario

I am thinking to wait another 2 weeks
Before applying
