Switching from Tier 2 G to PBS dependant and back to Tier 2

Post by atulgupta » Thu May 19, 2016 1:10 pm

Hi, I had Tier 2 General visa from Nov 2012 to Sep 2015, when I moved to Dependant visa from my wife (Tier 2 Short term ICT). Now I wish to apply for Tier 2 general from home country in May 2016, as my company has provided me with restricted CoS.

My question is, do I need to serve the cool off period, and if yes, will it be till Sep 2016?

Thank you.

Yes and yes. Cooling off period starts from the date your ICT dependent visa was granted.

Yes, cool-off of 12 months will be applicable from the date you moved out of your previous T2 General visa.

Thank you. So can I reapply for dependant visa, and that will not require the cool off period?

Sorry for the confusion.

Yes, but in the opening I asked about Tier 2 General. Since that would require cooling off, can I apply as a Dependant on my spouse so that I don't have to wait for cool off period?

You said you are already on a Tier 2 Dependent visa?

Please be clear in what you are asking if you want the appropriate advice.
