Help Applying ILR along with dependent (tier 2)

Post by sampath.nagarajan » Fri May 20, 2016 4:59 pm

Hi,

I am applying ILR in few months on 5 years Tier 2 route. My application seem to be straight forward.
My wife only recently (Feb 2016) moved to UK and currently on Tier 2 dependent visa. I am aware she has to wait 5 years to be eligible for ILR. So we are not worried about the ILR clock count.

However when I apply for ILR, can I include her as dependent? will she then move on to ILR dependent? Or should I apply first, get the ILR and apply separately for my wife?

Any guidance or suggestions regarding this?

Thanks a lot!!

You apply alone, you do not complete the form with her as dependent.

She can apply for FLR(M) once you are granted ILR if you do not wish to extend her current visa.

Thanks a lot for the reply Char.

Will FLR (M) be awarded for 5 years?

FLR(M) is granted for 2.5 years. She will have to pay the £500 immigration health surcharge for this too.

Near to the expiry of this 2.5 year visa, she will have to apply for FLR(M) again for a further 2.5 years, paying the surcharge again and meeting all the same requirements again (financial, English etc).
