Spouse Visa Employment letter

I will be applying for my wife spouse visa without any dependents so need £18600 to fulfill the financial requirement.

I have a emplyement letter issued form my employer as follows.

Start date: xxxx
Ni Nmbr: xxxx
Annual salary : £18,120
Cotractual Hours: zero
Job Title: xxxx

As annual salary is mentioned as £18120 but i have earned nearly £25000 in the last financial year after doing over time.

Also mentioned in my P60.

Now i am confused do i fulfill the financial requirement or not. will this over

time be taken into account by Home Office or not?

Your lowest value payslip out of the 6 you submit will be used to calculate your salary as far as I am aware.

Thanku.

Shall i still attach that employement letter with the application. I mean that mention of £18120 salary per annmu wont have negative impact as far as i have minumun £1550 gross pay and last 6 payslips??

Also the letter was issued in march. Do i need to get a new letter or this one will do?.

My employement letter is on simple plain letter head of company..it is signed by HR with all HR contact details but not stamped. Do i need it stamped.

Should there be any mention of this over time in the employment letter??

1. The employer's letter is mandatory and should be dated no later than 28 days before the application is submitted.
2. It isn't mandatory to have the letter stamped as long as it is on Company letterhead and signed by the employer or HR.
3. Mention the overtime in 'additional information' or in an accompanying letter.
(Casa, not CR001)

Please can u let me know if i get a letter from my employer which states the following

Job title
Hourly rate : 7.20
Contracted hours : zero

I am thnkn there is no need to mention annual salary as the visa officer can work it out himself by seeing the payslips ?? Will this employement letter b acceptable....

No, it seem he is in non salaried category A with zero hour contract and in that case they will add up last 6 month salary divide it by 6 and multiply with 12 to count annual gross salary

You are not in salaried employment so i am surprise how they managed to write annual salary on your employer letter when they mention that its zero hour contract lol

you basically need to mention your average salary in the last 6 month if you are working at hourly rate and number of hours or salary vary each month ..they mention annual salary in case of sa;aried employment while mention average salary of last 6 month in case of non salaried..you can multiply this average salary with 12 to count whether you meet the requirement

Basically i get paid a minimum of 50 hours a week that counts as salary (this is what mentioned in my payslip). Any thing v work more than this which v definately do then get paid on a hourly basis. Now my payslips looks like

Salary £1510
Add hours 60hrs £xxx





Total salary 1510+xxx
Thats how my payslip appears. Now the employer have mention my salary on employmnt letter based on £1510 multiply 12 which is around 18120. There is no mention of any additional hours v do. But there is minimum £1550 wages cmn in my last 6 payslips.

What category under i shud apply??

Will my overtime b taken into consideration by homeoffice??

Plz advise how shall i approach the spouse visa strategy..

You will confuse case worker just like you are confuse yourself. First you have written zero hour contract which come under CAT A (non salaried) as you normally have no fixed basic pay or no of hours in zero hour contract. Then you wrote about fixed basic pay of £1510 plus overtime which come under CAT A of salaried

If your basic pay is £1510 in each month and you do overtime as well which they shoule mention on your wage slips and should also deduct tax then you need to mention in letter that your basic pay is £1510 plus overtime which may vary each month..there is difference between basic gross annual salary and overall gross annual salary and they ask for overall gross annual salary which should be equal or exceed £18600 so they count commission/overtime as part of salary as long as its been paid in the last 6 month so now you will come under cat A

Basic annual salary = £1510 * 12= £18120
Calculation of overtime= add up all overtime you did in last 6 month then divide it by 6 and then multiply with 12= whatever is the amount can be added to £18120 so i assume it should be at least £480
