From Tier-2(ICT) Long Term - Tier 2(General) within 2 yrs

Post by Harsh_UK2014 » Sat May 21, 2016 8:26 pm

Dear all,

I have gone through all the questions and answers on this forum and couldn't find the answer for this specific situation that i am facing right now:

I have Tier-2 ICT Long Term VISA that i received for 2 yrs in Sep 2104 and since then i am living in UK. It's been only 21 months living in UK and i am eligible to renew it after Sep 2016 for another 3 yrs.

Now, if i find a different company and sponsor who is ready to give me Tier-2 General visa, then, can I switch to this Visa by resigning from the current company and then come back with the Tier-2 General Visa without any 12 months cool-off period.

My biggest concern is around cool-off period. Is it possible to resign from the current company, go back to india and come back with a different company on Tier-2 General Visa without any cool-off period?

This cool-off period should only come into picture after living for 5 yrs on Tier-2 ICT Long Term Visa, isn't it?

Please correct me and guide me.

Thanks!

No, this is not correct.

You will need to serve a 12 month cooling off period before you can return.

You might be able to switch if your new job is on the shortage list or you are earning in excess of £155K.
