EEA Form AN - Letter from employers?

Hi
I am Italian, I have lived in the UK since 2004 and married to a British man since 2007, therefore I intend to apply as applicant married to a British citizen.

Thanks to this forum, I managed to gain the PR document last March.

Now I am re-reading the most recent versions of the AN form, booklet and guide (all with different dates, and with sections that dont even seem to match with each other, good grief, what a bad work of copy and paste).

When it comes down to Section 3- good character, the appendix list of documents requires in a very confusing way:
Evidence of lawful residence during the 5 (or, if the applicant is married or in
civil partnership to a British citizen, 3) years before the date of the application: required for
applications made on the basis of residence in the United Kingdom: required for all applicants

• Your passports Or
• Letters from employers, educational establishments or other Government Departments
indicating presence in UK


1- Despite the wrong usage of the colon, I seem to understand that "all applicants" have to present these documents (even for applicants via marriage), is this correct? Do you read it the same way?

2- How come that either the "passport" or "letters" from employers are necessary? How would I know if my passport is enough?

3- Can I provide a P60 instead of a letter from employer?

Have you missed the OR after passport? If you don't have the passport (some people don't) then you need the other documents.

Passports OR letters prove residency. ALL applicants have to prove residency.

Thanks for your prompt reply but I am not sure we talk about the same thing.

Passports do not contain any information about current residency, not mine at least. Only on my driving licence displays my British address.

My Italian friend just went to have her documents checked at the nationality check service (she has a passport) and she was sent away as she did not have her bunch of "letters from her employer" but simply her contracts (she works as contractor).
That is why I put this post, as the whole thing appears confusing.

EEA passports do not prove residency as they do not get endorsed with stamps. EEA nationals need to provide P60s, employer letters, bank statements, tenancy agreements or utility bills instead.
P60s instead of employer letters are fine as they basically prove the same thing, especially if the employment was full-time.

Hi Lily thanks for your reply, it makes sense.

Still, it seems weird that I have spent long time trying to proof my residency and then I have to present all the documents all over again?
Besides, if you look at section 3, good character, on the form, it does not have anything to do with the residency, hence why should the summary of the documents require them?
The form section, 2, about the residency simply requires the permanent residence card...

So in summary it looks like they amended the form once again, without really amending and keeping up to date the final summary of documents requested.

Did you have recent comments on this regards from the nationality check service?

Rather annoyingly while the AN guidance from the HO does point out you need the letters / P60s etc if your passport does not get stamped on entry, the NCS I am booked with provides their own guidance which contradicts this and says you only need a passport or letters etc. My appointment is tomorrow and I have packed all P60s for the last 6 years, tenancy agreements, a letter from a private landlady and my mortgage statement, plus I have my employment contracts as a backup if needed.
