I'm looking for advice if anyone can help.here is my situation.
I live in the uk from August 2008.i became a self employed person and I have tax returns from 2008 to2011.then in 2011 and 2012 and 2013 I was a student. Then in 2014 up to now I was working full time. I recently applied for a British passport for my daughter born on 29 January 2016. I was refused because for the time I was a student I couldn't provide a Comprehensive sickness insurance.i wasn't aware I need it one and never heard about it till today.now I spend 1 hour on the phone with the lady dealing with the passport application and she couldn't answer my question: if I lived in the uk for nearly 3 years 2008 to 2011 as a self employed and paid all my taxes then I became unemployed or student do I still need comprehensive sickness insurance? She couldn't respond so she just refuse my application.she was giving me examples about people that from the entry in the uk are self sufficient or students.i looked everywhere and can't find anything about my situation. I'm from Romania.thank you in advance

Yes, you would have needed CSI for your student years regardless of your tax paid as self employed. You cannot count your student years towards YOUR permanent residence status if you did not have CSI.

Thank you for your answer.so I can't count them but does that mean I have to count 5 years from 2014 and or I can add up 2009 to 2011 so I can make the 5 years?

You require five continuous years of exercising treaty rights.

You clock stopped when you became a student without CSI. It started again when you started working again.

So, your clock will count down from 2014, when you started working again. You will be eligible for PR in 2019 and if you child was born in the UK, your child should be eligible to be registered as a British citizen then.

Is a bit unfair but never mind.now I'm in maternity leave and it will stop this month but I'm not going back to work.im taking couple of years off.do I need a CSI?

If you wish to acquire PR, yes.

You've said nothing about a husband. If you were married to an EEA national working in the UK while you were a student, those years would count towards permanent residence because you would have had the right of residence under the EEA Regulations as a family member.

I wasn't married at that time.i was living with my uncle and aunty. But from what they told me I still need it csi.

Not married.living together for 2 years.he is from Romania and only been in the uk for 2 years.in the eea regulations it says something about family member of your household so can I get my uncle for those years?

Possibly. But not sure how the requirements for Extended Family Members works if the EFM is also an EEA national.

I didn't. That's where I got stuck and refused.im a bit despite now and looking for a way around it.at the time I was living with my ex partner (British) and my uncle that has a yellow card since 2010.is there any way I can fight this? Thank you all for your help.

As an extended family member, you will first need to show that you had a registration certificate as his extended family.
