Dependent visa curtailed- Need Help

Post by karter87 » Sun Jun 05, 2016 4:45 am

Dear Mods and gurus

I have a critical situation and i desperately need your advice

its a long story please be patient to read and give me advice

I came to UK at young age in 1991 with my parents and lived in UK for 6 years and when my mom and dad split my dad took me to Nigeria in 1997 and in 2003 i came to UK on visiting visa and stayed here until 2008 studying in college without visa. In 2010 i got married to a British citizen and applied as a dependent and after long fight in court i was issued visa in 2013 in 2015 my visa expired so i applied for renewal and was granted in Feb 2016.

My wife and me had issues and we had to split up and she informed the Home office regarding our split so they curtailed my visa and asked me to make a fresh application or leave the country by end of July.

I am in a confused state now what to do one of my friend suggested i need to go for right to retain residency considering that i stayed with a British partner for more than a year. some were saying try asylum. i am not exactly sure what to do?

Please note i don't have a biological child with my wife so i cannot go that route.

Please give me your valuable suggestions to me what would be the best solution for me.

Many Thanks
Karter

If you are not in a subsisting relationship with your partner (and there are no British children) the only paths open to you are Tier 2 and Tier 4, provided you met the requirements for one of them...

There is no retention of right of residency for being in a relationship for any length of time, unless you have gained ILR during your time in the relationship.

An application for Retain right of residency is ONLY applicable if you were married to an EU citizen (not British) and meet the requirements. So this is not even an option for you.

Asylum - what persecution do you face in Nigeria? Unlikely to be successful with an asylum application.

Thank you very much for your replies

Do you think is there any other option for me as i have no one in Nigeria at the moment and after coming here in 2003 i never went there and lost contact with my dad.

i don't have the option of tier-2 or 4 as well please suggest any ideas you got.

my wife moved out with another guy so she wont be my help in anyways.

Literally i have no place to go at the moment...

Thank you

As your stay has not been completely legal, there are no options in the rules... Sorry.

It might be a good idea to start looking for a place to go?
