Spouse - LTR - police caution -5yr route

Post by Worriedincrawley » Sun Jun 05, 2016 10:06 am

Hello

Any and all advice very gratefully recieved. My husband is applying for his second period of the 5 Year spouse visa. the new FLM (M) asks for police cautions to be disclosed under the suitability requirement. I can see from other posts that it's very hit or miss in terms of approval for LTR with a police caution.

I am seeking advice on evidence we could submit to improve his suitability and to try and counter act a police caution recieved less then a year ago.

Aside from the police caution we have a strong application, we meet the financial requirement 4 times over with long term employers in professional roles, We hold a five year tenancy agreement and have many shared financial responsibilities and lots of relationship proof.

We have booked an appointment at the premium same day service and hope being there in person will help.

I am so worried that a silly mistake will turn our whole life upside down, so if there is anything I can do to assist with the good character elemen?

Thank you for taking the time to read and contribute you can't imagine how grateful I am for any and all suggestions in this stressful time.

What was the police caution for?

'Character letters' won't be looked at if that is what you are thinking of submitting.

Assault by beating. I was hoping I could do something with a character reference or just anything to even this negative out in what would have been a strong application.

I am not sure if case workers can use their discretion to approve in a suitation where there is a police caution. Do you have any views on this?

In case anyone else has the same issues as my posting, I don't know the exact rules but our visa was approved despite the police caution.

We included a letter after the section we declared it in, explaining the circumstances and the regret we had for the incident. we also used the same day service so we didn't have the stress of waiting an longer then a day.

I think police cautions are mostly an issue at the ILR stage.

Congrats, glad all went well.

Yes, for ILR it will need to be declared and for citizenship. Both of these are more stringently checked.
