how long a dependant can stay outside of UK?

Hi All

I have an ilr for more than 15 months and I have recently submitted my naturalization application. my wife is currently on a spouse visa (flr m) - it was issued last November 2015.

she is planning to go india in the next few weeks time to complete one exam which she left outstanding when she came to uk. now we think 3 months should be enough for her to prepare and give exam however due to complex nature of the exam & requirements of specific result she might have to attempt again if she don't get the desired result.


1. so in case if she has to stay longer than 3 months would that create any problems for extension after 2 years? or in her ilr application after 5 years?

2. not sure but is there is any provision that you can't stay longer than 90 days at any given time or not more 540 days in 5 years time.

3. what is the general rule with regards to this situation



Please any help is much appreciated.

1. Should not be a problem. For ILR only absences of 6 months or more have to be declared.

2. No, there is no such provision for extension or ILR. She will need to note the absence provisions for citizenship though which is 270 days in 3 years and 90 days in last 12 months for spouse of BC.

3. Absences should be limited and for good reason. You will also have to prove subsisting relationship when applying for extension and ILR.
