Hi,

We have employed a domestic worker from overseas (SE Asia) for several years and each year the visa has been renewed without problem (since pre Nov/Oct 2010). This year the visa has been refused and 14 days for appeals have been given. Also, the worker's passport hasn't been returned, although this is not unusual, I believe, in cases such as this.

The issue is that the hours worked is too low to be a full time job. I have spoken to someone at the immigration service, but they were quite vague about what we could do next. Is it possible to submit a new visa application (FLR0) and amend the hours worked to meet the criteria.

It's possible for us to do this as we can extend the work needed to be done. We, including the domestic worker, are all happy to do this, but would it be accepted given the recent refusal?

Also, does anyone know what hours are accepted. The hours have changed very little between the years that we have applied, and it seems that we must have fallen beneath some benchmark this year.

I don't think we can appeal the case as the decision was made based on the information given by us. It's more a question of the potential success of a new application. I was told that this would be an out-of-time application which would mean no appeal if refused. But, given the visas have been granted every other year I think this shouldn't be a problem.

Full time work is normally taken as min. 30 hours a week.

You'll need to draw up a new employment contract which should be submitted it with his/her new visa application together with a letter from you,

The worker's previous (good) immigration history is not really relevant, the caseworker will just apply the current rules.

If his/her visa already expired she s/he should re-apply within 28 days of the refusal.
