FLR(M) extension - is my dependant "applying with me"?

Post by Schwang » Wed Jun 08, 2016 8:38 am

Hi!

I am extending my spousal visa FLR(M), 5 year route.

After my initial application, my British wife and I had a child. The child was born in Britain and is of course, British.

In section 4, of course I'll need to provide her particulars. However, the application form lists several sections for use if a dependant "is applying with you". Do I include her in these sections as well?

Example:
Payment Guidance pg3: Am I the only applicant and thus I pay £811, or is she considered to be applying "with me", thus I pay $1622?

As a general guideline, I'll need to consider her as a dependant, but not as a dependant "applying with me". Is that correct?

Your wife's not your dependent. she's your British sponsor, so you're applying alone.
Don't forget to pay the NHS surcharge of £500 in addition to the £811 postal application visa fee.

Thanks Casa, but I'm referring to my child dependant, not my wife.

If your child is British they're not your dependent for the purposes of the application either. You're applying alone. Proof of £18,600 p.a income required, but these can be joint earnings with your wife if necessary.

Great, thanks Casa.

I guess I still need to provide my child's details in section 4:
As well as children who are applying as your dependants you should also include details of all dependent children including those who are British citizens or settled in the UK.
...but I wouldn't need to mention her anywhere else, right?

Thank you on behalf of everyone...and extra thanks for recognising that some of us are female.

Please post if you're stuck with any other points on the application.

I'm in the process of paying the NHS health surcharge. There is a section on the surcharge application website where you can add a spouse - which I won't do as it mentions that you can leave it out if the spouse is British.

Similarly there is also a section where you can add a dependant.

Considering my situation, in which I'm applying alone but I have a 20-month old child who is fully British, do I need to add her as a dependant here?
