T2 G queries - Urgent please

Hello all,

Please I need some advice on my Tier 2 visa application. This is my first post on this forum though I am following it for a long time.

I submitted my T2 G visa (Shortage Occupation job) on 6th of April, my T1 G visa expired on 12th of April.

My T2 G visa application is still in process, but now I realise a mistake in a COS issued. This could cause me a rejection of my application. My company is not a qualified company for issuing that particular code.

However, when I discussed this issue with my company they advised me to wait until the UKVI made a decision on my application.

I have no option left other than to have a plan in mind in case of rejection.

Suppose, if the T2 application gets refused and my visa would be expired by then.

1) Can I re-apply in 28 days grace period without being considered overstayed?
2) Can I apply for AR and during the process can I vary my visa application?
3) Will it break my continuity of my stay in UK if I put a new application within 28 days?
4) Do I have right to work in this case 2?
5) Can I switch to T4 category for PhD and again can I switch back to T2 G?

Please quick reply will be appreciated.

We have jobs and families, so someone who can answer might be busy.
My company is not a qualified company for issuing that particular code.
What do you mean by this? What SOC code is it?

The answer is Yes and No

Yes - My job description matches with the Data Scientist and working in this company from last 3 years.

No - The company is not qualified company as My organisation is quite big and does not fulfils the requirement of qualifying company.,

I know this could cause me a rejection.

I just want to make a plan B in case of rejection.

I wonder if you can advise me.

If it is not a qualifying company and you can not avail yourself of the shortage occupation code then the best thing is to get your company to conduct a RLMT and issue a new COS.
If you get refused this is the only option available to you in any case.
Best they start the proses now rather than wait as it can not be completed in the 28 day grace period.

In the case of varying an application, the biometric provided with the initial application could be used or do I need to provide it again for a new application?
