Spouse visa refused - please help with appeal

Hi

I wonder if anyone can help. My husband and I submitted our application on 14th March 2016 and are awaiting a decision. On reading some of the comments on here i notice that reference has been made to being invited to an interview. I haven't seen any comments posted this year that suggest these interviews still happen so if someone could let me know I would be grateful.

Also, has anyone recently had a decision for a jamaican spouse to enter the UK as originally we were told 60 days, then 90 days and then a maximum of 12 weeks.

Any information you could provide, as well as how the decision is communicated would be greatly received. Anyone who has been in this position will know how stressful and nerve wracking this is, and for some weird reason I have convinced myself the decision will not be what we are hoping for :(

Hi MrsP

My husband is also from Jamaica and we submitted our application on the 17th March 2016. Today is the 8 week mark for us and we haven't been contacted about an interview as yet. Our solicitor said we may or may not receive a call for one. Hopefully we should get a decision within the next few weeks.

Thanks for your reply.
My solicitor never mentioned anything about there being an interview so this is news to me. But if we are called for one i'm sure it will be fine.

The timescales are really confusing but hopefully we get a response soon - it feels like forever!

UKVI confirmed on phone decision made but no email recieved

Hi

does anyone know how long it takes for UKVI to send an email confirming a decision has been made/collect documents?

I called UKVI yesterday as the 12 weeks has now passed and they confirmed that a decision had been made but couldn't tell me the answer over the phone as they don't have access to it. Has anyone else gone through this process? If so, how long after they confirmed decision was made did the email come through?

It's so unfair that they keep you waiting even after they have made the decision. They clearly don't realise the stress and anxiety it causes.

Any help would be great.

SPOUSE VISA REFUSED - PLEASE HELP WITH APPEAL

Hi all

After 3 long months of waiting for a decision on our application, we found out yesterday that the visa had been refused on the grouds of my husband being a 'persistent offender' - even though he met the requirements for everything else.

When in the UK he had a number of convictions (petty but still convictions none the less) that resulted in him being removed. He left the UK 7 years ago and has had a clean record for 8 years - which they noted in their refusal letter. He provided his police record from his current country which confirmed he had no record, however this was not mentioned in the refusal letter. He also provided a copy of his UK record which was also clear due to the convictions being spent.
We are now going to appeal and are praying that the decision can be overturned rather than having to go through the full appeal process as this can take close to a year.
I should mention he also has kids from a previous relationship in the UK who the immigration said he can maintain a relationship with through 'modern communication'!!!!!!
I have spoken briefly to a solocitor who thinks we have good grounds on human rights and also the fact his record has been clean for such a long time. I know that this does not deter the fact he had those convictions, however I do think it should have some bearing.
I would appreciate any help or top tips on what you think i can do to make the appeal form as strong as possible. Also what other evidence can i provide to demonstrate he is a changed character? I have asked my local MP for a supportive letter, however short of that i'm not sure what else to do.

Sorry to hear what's happened especially after such a long wait. Have you checked other similar questions on here to see how others managed a successful appeal?? There might be a few more ideas and tips that could help you out. Keep positive and if possible keep me updated to your situation. I still have 7 days until I will be able to call and ask for an update for my husbands visa.

Thanks for your response. I can't say it as come as much as a shock as my husbands case was not straight forward. We have appointed an immigration solicitor now who will appeal on our behalf and we are confident he will eventually get through.

I called up UKVI a little before the 12 weeks had passed and they were able to tell me that the application had been reviewed and the decision was ready. I n some ways it's worse to know that information because waiting for the answer seems like a lifetime!

Application submitted 14 March
Decision made 1 June
Decision received 8 June.

Good luck, i hope your husbands application is successful. I will keep you updated, however the whole appeal process could take up to a year!!!
