FLR FP(mother of British child) overstayed CAP final Warning

hello guys,


Very stressful time passing these days. I need professional advice.

My wife overstayed nearly 2 months due to appeal dismissed and now kids are on British citizenship but we receives 4 capital letter like every 2 weeks . I have discussed with my solicitor and he's dealing and we trying to send her fresh application very soon and solicitor saying ignore the letters and he wrote to capita company about the situation but correspondence link is still on my home address.

And received phone calls too they want us to put application very quickly or leave uk but due to financial crisis we took little delay options

So the last letter from capita saying that case is forwarded to detentions team and due to no legalise stay of my wife they will put to detention. So we received this letter today. My laywer is also taking time he can't do application just blindly so he want time.


So i want advice ..if detention team knock my door they can take my wife ??

I got 2 kids British citizen.

I hope some gurus will guide me on this situation.

History:
My wife appeal was dismissed due to kids was not registered so after appeal we got out kids citizenship approval that's why all thing disturb. Now applying for fresh application

Your solicitor could have sought reconsideration.

Don't worry about capita. There is no power in law to remove the parent of British citizen who has genuine parental relationship with child, unless there is serious criminal offending..

Second thing if my wife get flr fp then she is looking to get switch on flr M which is not possible to switch inside the UK ?

is that correct?

She can switch in the UK to FLR(M) if she is on FLR(FP) visa.

Thanks a lot for your reply. Could you please send me any ukvi rules link for this switching link. So i can show to my laywer because he saying she have to leave uk to switch from flr fo to flr m please if any web link available that will be so helpfull.

FLR = Further Leave to Remain - you cannot apply for FLR(M) from outside the UK.

See link below, any category of visa (except visitors) can switch to FLR(M) if they meet the requirements.

Like my situation is explained on above my wife looking to apply flr fp now through lawyer but is there any chance she can apply on same day premium service for flr fp ?

If yes then don't you guys think its first time flr fp and she's overstayed nearly three months so will this effect on same day application.

We looking to know if she's ok to have same say day application then it's great life easy to travel in summer holiday.

I'd strongly advise against applying in person through the PSC. This is for straightforward cases as the junior level Case Workers don't have the authority to make a decision on a complex application. At best it would be passed to a Senior Case Worker for further verification and would join the postal queue at the premium fee, or at worst if could be refused on the day. Your 'lawyer' should have advised you on this. Hopefully it's not the same lawyer who believed a FLR(M) application should be submitted outside of the UK.

Personally, I would put a Summer holiday at the bottom of the priority list.
