Hi all,
Many thanks to all the members who have been helping a lot of people like me to get answers to the immigration queries. We are hoping to get some more help from the members on this site.

We are going through relative adoption from India and my wife and myself both are British. We have already got approval as prospective parents from adoption agency and have got certificate of eligibility from DfE (Department of Education). Our case is with CARA India for the approval and NOC and it making progress. Hope all goes well and we should get CARA approval soon. The next step is to apply for visa or passport, can someone on this board please suggest us on the list of documents which we will need to submit while visa/passport application to Home office? I've gone through the document list specified on home office site - https://www.gov.uk/government/publicati ... es-qualify . Few points on these seems to be vague, so not sure what documents will be best to supply at the time, for example -

• was adopted due to the inability of original parent(s) or current carer(s) to care for him/her and there has been a genuine transfer of responsibility to the adoptive parents and has lost or broken ties with the original family;
• has not been adopted merely to facilitate entry to the UK.

Also can someone please suggest which form/category should we apply for and how long it takes please? Any help will really be much appreciated.

Complex area so an appropriate professional advisor would be advisable.

Who is the relative you are adopting the child from?

Why can't this relative look after the child?

What process in the UK (as British citizens) have you followed to allow you to adopt a child abroad?

HO takes a very dim view of such adoptions. Please see Point 18. SET7.18 in the link below

I've gone through MN1 guidance and am already in the process of taking advice from solicitors. Do you know any good solicitors in this area who have done relative adoption cases before please?

Yes the adoption is as per Hague convention though we are still waiting for the adoption process to finish.

I'll keep you posted about the progress and might come up with more queries as we go along.

Relatives are my wife's brother and sister-in-law. They cannot look after the child because they already have 2 kids to take care of and because of their health issues . They wanted to abandon the third child but the doctor advised against it because of the complications.

We are following the adoption process as per the adoption agency, which is to get the approval from adoption agency, DfE (Department of Edu), CARA India and HO visa/settlement. I've gone through SET7.18, 20 on the above link and trying to make sense of all the documents required to support the HO requirements. Any advise on that please?

We don't actually see many adoption cases documented in the forum but your experience may ofcourse help others.

The Board is not in a position to recommend legal professionals - it would just be a case of searching via the Law Society.
