Post by Wakizashi21 » Mon Jun 13, 2016 8:01 pm

Hi all,

In need of advice please. I currently work for government department and my salary is £18450 which mwans in 150 short of the financial requirement.

1. We have a child together and expecting another in december.
2. Visa expiring 01/2017
3. Currently i am working only as she is pregnant.
4. What documents are required?
5. Do we submit application by post or online?if so, how please?
6. What happens if i cannot meet the financial requirements?
7. I currently own the house and my brother gives me monthly rent of 175. Can this be counted?
8. Can i make this application myself as the solicitor fees are too expensive and we get no benefits.

Thank you. Look forward to your help

4. What documents are required? Suggest read through the FLR(M) form and guidance notes.
5. Do we submit application by post or online?if so, how please? Paper form, apply in person (£500 more) or by post.
6. What happens if i cannot meet the financial requirements? She won't get a visa. If you do not meet the requirements, she can apply on FLR(FP), likely will reset her clock to zero though and put her on a 10 year route to ILR.
7. I currently own the house and my brother gives me monthly rent of 175. Can this be counted? Do you declare this income for tax or did you sign up to the 'Rent a Room' scheme? Third party family support cannot be used for a spouse visa.
8. Can i make this application myself as the solicitor fees are too expensive and we get no benefits. Yes, you don't need a solicitor

Thank you. Look forward to your help

Hi,

I have savings of around 10k.

I do have family members who can gift me whats needed.

Im hoping i can back date the rent a room scheme as brothers renting the room in the main property paying half of the mortgage.

Not entirely sure how to apply for this.

You cannot use family gifted money to make up a shortfall. Any such money will have to be in your bank account for at least 6 months to qualify.

Not sure you can, also not sure how this will sit with HO given that you are 'renting' to a direct family member. Suggest not even use this tbh.

Complete the form and post it with the supporting documents. OR complete the form and apply in person. She will also have to pay the £500 immigration health surcharge BEFORE she submits her application.

What is your immigration status?

I am British and my baby girl is British too.

She is Pakistani and current visa expieing in Jan 2017.

Would it be worthwhile to apply for a part time role ontop of the actuall full time to make up for the shortfall?

Why would it be an issue if i am renting to a family member?

Thanks for all the advice.

I mean i have earned over 18600 over the year...with bonus payments and overtime. I started working for Government in Jan.

Can i supply 12month payslips to cover 18600?

What happens if i fail to meet this?

A part time job would do the trick.

If you are not declaring the 'rent' as income and don't have extensive records/TA/paperwork etc, then I would suggest not to use it.

If applying for extension in Dec/Jan, you need 6 months payslips at that point or 12 months if including overtime, bonuses, part time work etc.

If you fail to meet it, HO will likely issue her a FLR(FP) visa.

Perfect! I think i would meet the requirements under the 12 months. I will need to double check this. If i get a part time now and say i get recruited in aug or sept...is that acceptable?

And aorry what is FLR? Is that the 10 year route?

What if i get an promotion...(which i have applied for) and want to apply under the normal 5 year route again?is that possible?

Do they not offer a 1 year extension?

And aorry what is FLR? Is that the 10 year route? FLR(M) is the route she is on at the moment and you need the financial requirement for. FLR(FP) is a similar route, but if you don't meet the requirement and is a 10 year route to ILR.

What if i get an promotion...(which i have applied for) and want to apply under the normal 5 year route again?is that possible? Yes, possible.

Do they not offer a 1 year extension? No they don't. It is a 2.5 year extension

I have spoken to a Solicitor who is a friend and he stated we can legally apply for child tax credit as a couple however it may effect gaining a nationality?

Has someine heard about this too?

I assume that he doesn't specialise in immigration law.
Claiming WTC or CTC won't affect future visa applications or BC if they are claimed in JOINT NAMES.
Child Benefit should be claimed in your name only.
