travel on indian passport after british citizenship

Hello,

I am pretty sure this question has been asked before but I couldnt find the exact details, so excuse me for this duplicate query.

My son (20 months old) is currently on an indian paspport with a dependant UK visa valid till June 2018. I have applied for British Citizenship and got the passport for him today (14/06/2016).

My son is travelling to India with my wife on 16/06/2016 and returning back to the UK on 20/07/2016. My query is

1. Can he travel on Indian passport - I read about the grace period of 3 months that the Indian govt allows for getting the documents updated.

2. If yes, which passport to use on return - will the immigration control in UK have an issue with returning back on UK passport

3. Will there be a fine imposed by Indian consulate when I surrender Indian passport

4. What about the BRP return - I have read that the BRP needs to be returned within 5 days of acquiring citizenship (note that he doesn't have an ILR, its just dependant visa valid till June 2018).

Remember that the grace period of 90 days for the use of the Indian passport starts from the date on the registration certificate, not that of the British passport.

UK Immigration authorities will have no issues with him entering the country on a UK passport.

Also,

I have applied for the british citizenship for my son using the Nationality Checking Service ( pilot scheme - both registration and passport at the same time)

Whilst my son has received the passport, we haven't received any certificate of registration.

I am just wondering if the process has changed now or if I should have definitely received the certificate of registration.

You should get the certificate as that is the proof that he is British. It might still be on its way. It comes in a brown A5 envelope, make sure it has not been delivered but missed as junk mail.

Did you apply for naturalisation on form AN as well or was it only for your son?

I have applied for naturalisaion as well but it was a separate application. I applied a month before I applied for my son.

Strange that I received the passport before the certificate.

One more question, do I need to carry that certificate while travelling out of the country along with the passport.

And, do I need to return the BRP of my son before he travels to India. I am slightly worried as he's travelling to India on 16/06.

No, the British passport is sufficient. Registration certificate is not a travel document.

Certificate might still be on its way.

He doesn't need the BRP if he has a British passport. Why do you think he needs the BRP?? It should be returned to HO.

But, does he not need the BRP to travel to India. Will just the Indian passport do to travel to India then.

If that is the case, I will return the BRP to Home Office and

make sure he will return to the UK using the British passport.

The BRP has no relevance to Indian immigration. It is for UK immigration and re-entry only.

He may need the BRP to exit India. Indian immigration check whether you have a valid visa to enter the country you are going to. If you show the British passport, they will want to see the Indian visa in the British passport. In the absence of an Indian visa in the British passport, there may be fines and delays involved. If you show them an Indian and a British passport, you may encounter problems at the counter. I am sure you are aware of the reputation of Indian babudom (@CR001, babudom is the Indian English word for the local bureaucracy).

The advice above is based on hearsay. I have never been in such a sitaution myself but have been so advised by others who have been. You may wish to wait for others to comment.

I agree with Simon, please consider below before travelling :

1) There is no rule such as grace period of 90 days mentioned an anywhere on VFS website , it clearly states that you have to surrender indian citizenship immediately.

2) Travelling out from UK on British passport and showing Indian passport on arrival in India is not an issue as well but as Simon mentioned whilst coming back you need to go through with the immigration and if you show them indian passport they will ask for UK visa or if you show them British passport they will ask for Indian visa , which can create a lot of problem as it's illegal to held two citizenship's according to
Indian law.
