Hi all
Am new to this site and I want to thank you all for sharing your experience .I enter uk Jan 2015 on a student visa and had some issues with my uni and got expelled Dec 2015 and I tried to appeal but was refused . Prior to that I have been in a serious relationship with my partner who is British since and have been leaving together for over a year and half and still do. She is also a student and a part time career, who I met at uni. Early Feb 2016 I got a letter from HO informing me that my visa has been curtailed till April 13th 2016 and as such should make a new application or make arrangement to leave . So i tried applying for ancestry visa since my own grandfather was British, but was informed by my lawyer that it can only be done from outside the country. And I couldn't just leave my partner because we found out she was pregnant. I was advice by my lawyer to apply for Flp Dl before my curtailment deadline, of which I did.
Please what are our chances. Responses is highly appreciated

Received by Ho : 5th April 16
Letter from capita : 21 April 16 ( asking if I had made an application or arrangements to leave)
Debited by Ho: 23rd April 16
Letter or Ack : 9th may 16 (stating that APP is complex and involves HR so it will take some time)
Biometrics received and done : 3rd June 16
Letter from Gp sent to Ho confirming pregnancy: 7th June 16
Response from Ho pending



So my question is how long do we wait and what maybe our potential outcome.

IMHO your chances are slim. I assume that your baby hasn''t yet been born so you can only claim to be the future father of a British child. In addition, you aren't married and don't qualify as unmarried partners as it appears that you haven't been living together in a relationship 'akin to marriage' for at least 2 years. The HO are playing hard ball with 'anchor baby' applications in order to secure residence.
If your girlfriend is able to meet the minimum income level of £18,600 p.a you would be wiser to return to your home country, apply to re-enter on a fiance visa, marry in the UK within 6 months and then switch to FLR(M).
You've chosen a very long, bumpy and uncertain route.

Edit: FLR(DL) is an application for extension of leave following the refusal of Asylum. This doesn't apply to you.

Would have been far more logical and simple and less stressful (and a clean immigration history/record) to return to your home country and apply for an Ancestry visa which you say you qualify for, assuming of course you are from a Commonwealth Country.

Pregnancy is not a illness and Ancestry visas, if you have all your paperwork in order, are fairly quick to be processed.

HO will be bound to ask if there's any particular reason why gf cannot resettle in your home country. (Children are very adaptable).

@naojthan my partner is still studying and can not relocate with me, and those not earn £18k so that was why we were advised to apply for discretionary leave since it is usually made outside immigration rules . That in mind so what advice do you guys have to give to us as a next line in action , since the Ho haven't made a decision yet.

FLR(FP) raises the same issues I mentioned in my previous post. You don't qualify as unmarried partners and you won't be considered under the parent route as your baby hasn't been born yet.
CR001 has come up with the most sensible option, via the Ancestry route.

My partner is saying that if I leave her with the pregnancy to return home, she's not going to keep the baby if am not going be here. And that she don't want to be a single mom. So what do I do as am absolutely confused

Here's your answer (above).

The University of Life is a hard taskmaster.
Emotional blackmail won't work with HO and that is who you have to deal with to straighten out this mess.

Anything else (family matters) is not an immigration matter and not appropriate to discuss in this forum.
