Can I switch from Tier 1 PSW Route to Tier 4 for Post Graduate Degree? bcecause I am founding it difficult to invest 50k as my business is running in loss and I cant afford lose any more money. And I only got 2 years left to apply for ILR 10 years route. So if I go for the student I can complete the 10 years in UK. Only question is that is it allowed to switch by law?

Switching to Tier 4 (click)
Also depends on previous study and if you have reached the cap and if you can show 'progression'.

You can switch from Tier 1 PSW to Tier 4 but how is this relevant to Tier 1E forum ????

Well he says Tier 1 PSW in his question. Switching from Tier 1E to Tier 4 is not allowed.

Nish,
Most businesses run at loss initially (cashflow negative for sure no matter how you define P&L), that is why investment is needed. Seems you have to focus on making your business work.

No. Both of you must apply from outside.
You are not allowed to switch to Tier 4 and your dependants are not allowed to switch to any PBS category.

So if my wife who is on dependant visa currently goes back to India and apply for Student visa from there and come back will she be able to apply for ILR 10 years route?

Depends on when her visa runs out. A dependant visa holder is allowed to study in the UK (as well as a Tier 1E visa holder) It make no sense for her to go back with a valid dependant visa and apply for Tier 4 again while you are here. UKVI will highly likely reject her application and investigate you both as it will be obvious that you want to just stay in the UK by gaming the system.

I had inquired about this option and I was told I can switch if I am progressing academically, means joining PhD after Masters, but the visa cannot be applied from within the UK. You have to go back to your country and apply, in which case you lose all the previous years and cannot apply for ILR.

if the dependent is a genuine student and can prove this with her previous degree and relevant work experience and or interests. Or acedamically progressive and some sort of pre-research evidences like paper presentation etc and she is opting for research based degrees forexample. I dont think they can reject the application. Especially if her current visa is running out now.
It will just be a decision on balance of probablities. In such above scenario as i mentioned its highly likely the applicant is a genuine student. Otherwise if its just a random taught course or no relevance with no acedemic progression they might interview and decide on balance of probablities.

Absolute nonsense. Who told you this or where did you 'hear' it?
