Universal Credit is the income based welfare payment replacing 6 other other income based benefits. On UC, your claim is calculated monthly based on the income/capital/savings etc of both you and your wife - because you are asking for income based benefits. That is why her name must be on the claim. Have you decalred your wife's earnings/capital/savings to UC?tech21 wrote:Dear Immigration experts,
I Have got my ILR in Nov 2015 on 5 yrs tier 2 basis while my wife is still on Tier 2 dependent visa .I have started claiming Universal credit since Feb 2016 and child benefit .i need to extent my wife's PBS dependent to complete her 5 yrs for ILR.when i applied for Uni. Credit i mentioned everything abt status of my wife and they approved a single rate for me .
My child has already got British pasport on MN1 basis.
My wife has been in UK for 3 years we never claim any benefit until i got ILr but due to req. Of U. Credit both couple had to apply .My wife UC declined because of her immigration status as i already knew and i mentioned many times in writing while i was clamingUC but her name still come with me due to joint account.
My question is would it affect my wife PBS dep. Visa extension? and do i need to mention on form about this?.
UC comes to my bank account .My current pay is around 28 k.
Can some please reply to me
Thank you.
Is there something more than you need help on besides what Petaltop has already responded?Petaltop wrote:ForTax Credits, people have to make a claim using both names even if they can't take the Second Adult Element (more money) because they don't have children and their spouse can't have public funds. Perhaps one of these people would answer on how they filled in the visa application? I don't want to get it wrong.
For UC, they look at your household income and that includes your wife who may have an income/property she doesn't live in even if that is abroad./any land owned/capital etc. UC is different to the Tax Credits it is replacing. As long as you don't take any more benefits for her, then she is ok.
I would have thought that on an income of 28k with 1 child, you aren't getting much anyway.
